Privacy policy INFORMATION NOTICE PURSUANT TO ART. 13 (Legislative Decree 196/2003) ON PERSONAL DATA PROTECTION. Legislative Decree No. 196 of 30 June 2003 (“Personal Data Protection Code”) stipulates the protection of individuals and legal entities relating to the processing of their personal data. Moreover, Recommendation no. 2/2001 that the European Authorities, for the protection of personal data, consolidated in the Group instituted by Art. 29 of Directive no. 95/46/EC, adopted on 17 May 2001 identifies several minimum requirements for the collection of personal data online and, in particular, the terms, conditions and nature of the information that the data processers must provide to users when they access web pages, regardless of the reasons for accessing them. In fulfillment of that set forth by the regulations in question, processing personal data collected from www.sessamarine.com shall be governed by the principles of correctness, legality and transparency and the protection of your confidentiality and rights. In particular, pursuant to Article 13 of Legislative Decree no. 196/2003, we will provide the following information: 1. DATA CONTROLLER AND PROCESSER The data processer is SESSA MARINE Srl with its registered office in via Cortenuova, 21/23 – Cividate al Piano (24050 – Bg), Pec: sessamarine@legalmail.it, email: mail@sessamarine.com – represented by Cinzia Grottoli. The Data Controller is Valter Todeschini as the Computer System Manager. External Processing Manager for www.sessamarine.com is Studio Pleiadi Srl, 47521 – Cesena (FC) – Via Cairoli 35, as the website manager. 2. DATA PROCESSING LOCATION The processing related to the web services of this site occur at the offices of the external processing controller and processor that handles the management of the website. The data voluntarily provided on the website to register the request-registration forms in order to access determined services shall be logged in the Studio Pleiadi Srl database. Studio Pleiadi Srl, which manages the website, www.sessamarine.com, provides data regarding Sessa Marine Srl as well as the subjects listed under point 6). 3. PROCESSING AIMS AND METHODS FOR THE DATA The personal data that you voluntarily provided can be processed to: a) contact you if you have requested it by entering your data in this section of the website and comply as best possible with your specific needs to use the services provided through the site, such as, for example, information requests about services, events and shows, products, maintenance and technical assistance and any other service provided through the Site by Sesssa Marine Srl and/or the Parent companies and/or subsidiaries and/or affiliates on its sales and assistance network and/or individuals or legal entities that perform commercial activities at Sessa Marine Srl; b) marketing activities, such as: sending of commercial and/or promotional information, advertising material and/or offers of goods and services, the organization and execution of events and shows, including promotional activities in nature and other activities of Sessa Marine Srl by Sessa Marine Srl and/or its parent company and/or affiliates and/or subsidiaries, on its sales and assistance network and/or individuals and/or legal entities that collaborate in the commercial activities of Sessa Marine Srl. 4. PERSONAL DATA PROCESSING METHODS The processing will be done using the following methods: with or without the aid of electronic or automated systems and, in any case, to ensure the security and confidentiality of the data and, for the time necessary, to achieve the purpose for which it was collected. 5. NATURE OF THE DATA TRANSFER AND THE CONSEQUENCES OF A REFUSAL TO ANSWER The transfer of data is always optional, which means that it is not a legal requirement, but failure to provide the information marked with an asterisk as "mandatory" or the refusal to provide consent to processing makes it impossible for Sessa Marine Ltd. to provide the services that you have requested. The information sent is not used to analyze your habits or consumer choices but are only intended to filter information and commercial news of interest when it becomes available. 6. SUBJECTS THAT MAY BECOME AWARE OF PERSONAL DATA Within Sessa Marine Srl, your personal information, with your consent, will be accessible to company personnel responsible for the management of the services requested, with particular reference to the commercial and marketing, sales, customer care and IT departments as well as the Personal Data Manager and employees while exercising their duties. The list of such subjects is available to the user who sends a request to the address indicated in paragraph 8. Personal data may also be disclosed to our sales and assistance network as well as subjects that participate in Sessa Marine Srl’s commercial activities, providing services or key services for the purposes indicated in point 3) including Pleiades Studio Srl, the external processing manager. To achieve the activities referred to in point 3), Sessa Marine Srl may also use qualified subjects who provide services or instrumental services for the organization and execution of events and shows, including those that are promotional in nature. They can also be stored in a customer relationship management (CRM) computer database while respecting the rules of confidentiality and security required by law. Your personal data will not be disclosed to third parties and will not be disseminated beyond those listed in this information notice for reasons only directly relevant to the purposes referred to in point 3) and, in any case, in accordance with and with respect for the provisions of the law on privacy protection. The list of such subjects is available to the user who sends a request to the address indicated in paragraph below. It should also be noted that in some cases the Authority may request news and information pursuant to Article 157 of Legislative Decree no. 196/2003 to monitor personal data processing. In these cases, the Data Controller is required to respond. 7. RIGHTS OF THE INTERESTED PARTY Finally, we confirm that you can exercise your rights to access, read and correct your personal data and object to the processing of your personal data at any time as well as to see the complete list of Managers pursuant to art. 7 of Legislative Decree no. 196/2003. For your convenience, we have summarized these rights below: The interested party has the right to obtain information about: a) the origin of your personal data; b) the processing terms and conditions; c) the software applied in case of processing using an electronic instrument; d) the identification information of the controller, the managers and representatives appointed pursuant to Art. 5, paragraph 2; e) the subjects and categories of subjects for which the personal data can be reported or become aware of as the representative appointed in the territory of the State, managers or agents. The interested party has the right to obtain: a) the update, correction or, when applicable, the integration of data; b) the cancellation, transformation into anonymous form or blocking of unlawfully processed data, including the data whose retention is unnecessary for the purposes for which the data was collected or subsequently processed; c) certification that the operations under letters a) and b) have been shared, as regards their content, with those with whom the data was communicated or disseminated unless this requirement proves impossible or involves the use of means manifestly disproportionate to the protected right. The interested party has the right to object, in whole or in part: a) for legitimate reasons for personal data processing, pertinent for collection purposes; b) for the processing of personal data for the purpose of sending advertising or direct sales materials or to conduct market research or commercial communication. 8. ACCESS TO DATA AND MINIMUM SECURITY GUARANTEES The rights referred to in Article 7 of Legislative Decree 196/2003 mentioned above may be exercised by sending a request to Sessa Marine Srl, via Cortenuova, 21/23 Cividate Plan (24050 - Bg) or by sending a fax to (+39) 0363 976766. Sessa Marine Srl keeps personal data to be processed in order to minimize the risk of destruction or loss, even if accidental, and unauthorized access or processing that does not conform to the purposes of collection. For this purpose, all appropriate security measures, pursuant to Articles 33-36 of the Code and in full compliance with the provisions of the Technical Specifications (Annex B to the Code) have been taken. 9. CONSENT AS PER ART 23 OF LEGISLATIVE DECREE 196/2003 ON PERSONAL DATA PROCESSING 9.1 Consent for the use of the services provided for the purposes set forth in paragraph 3, letter a) of the information notice. Pursuant to and for the purposes of Articles 13 and 23 of Legislative Decree 196/2003, you must consent to the personal data processing for the purposes and methods indicated in this information notice, including the communication of data to all subjects indicated above, particularly in order to respond to requests to use the services provided through the Site. 9.2 Consent for marketing activities for the purposes set forth in paragraph 3, letter b) of the information notice. Pursuant to and for the purposes of Articles 13 and 23 of Legislative Decree 196/2003, you need to provide separate consent to allow commercial and/or promotional information and/or advertising material about products, services, the organization and events and shows to be sent, including promotional materials.
